Los Angeles DMV Hearings for DUI Is an in person hearing better than over the phone?

An overview of the DMV Hearing process is as follows.  A person who is licensed to drive in California or even other states who receive a DUI in Los Angeles will face a suspension of their driving privileges in California or even in their home state.  When released from the holding cell the person will receive a DMV Temporary License that states the person must request a DMV Hearing within 10 days or else their license will be automatically suspended.  At this point it is in the person's best interest to request a DMV Hearing within the 10 day deadline.

The DMV Hearing can be conducted in one of two ways.  First, the hearing can be done in person at the DMV Driver Safety Office, or telephonic.  The method to conduct the hearing is completely up to the individual not the DMV.  People who have recently received a DUI in Los Angeles and are looking to hire a DUI lawyer must be cautious of which method their lawyer will conduct the hearing.  Many dui lawyers will not show up in person to the DMV Hearing and conduct it over the phone.  There many benefits to conducting an in person hearing here are just a few:

  • Face to face contact with the hearing officer, makes the hearing more personable
  • Able to Cross Examine the Officer in person and notice any subtle conduct of   the officer that shows uncertainty or weakness
  • More difficult for the hearing officer to suspend the license when there is a face to the license rather than just a name
  • Easier to challenge evidence in person because able to point out damaging evidence
  • Attorney has built a relationship with the hearing officer over time
