Minor In Possession of Alcohol

In Los Angeles a common violation of a Alcohol related offense that is harshly enforced is Minors in Possession of Alcohol, 25662 of the Business and Professions Code.  Essentially this code is charged when there is a minor (someone under the age of 21 years) and they are in the possession of an alcoholic beverage.  The violation of this code does not mean the person was Driving Under the Influence of Alcohol (DUI), or even the person has consumed any amount of alcohol.

Most times this is charged as an infraction and no jail time is issued.  In rare situations Minor in Possession can be charged as a misdemeanor, where there is a possibility of jail time.  Another key distinction between an infraction and misdemeanor, with the former the charge does not appear on your record.  Where this comes into play is when you are seeking employment, you do not have to reveal this as a criminal record.

Penalties one will face for violatingMinor in Possession of Alcohol in Los Angeles are as follows:

                                  Fine up to $500

Community Service of 36 hours to 48 hours

                                  Licence Suspension for 12 months

The biggest issue that most people face is the California Drivers License Suspension for 12 months.  With the right attorney the charges may be dropped or reduced.  At worst your will be able receive a restricted license after 30 days if you can show good cause to receive one.  Another important note is if the person charged with 25662 BP and that person does not have a license at that time the DMV can place a 12 month hold if that person ever decided to apply for a driver's license.  Please contact the Law Offices of Loren M.
