Different Types of Blood Alcohol Testing for DUI’s

In California, there are a few common methods of testing which law enforcement administer on people who are suspected to be operating a vehicle while intoxicated.  Also, the person thought to be under the influence of alcohol has a choice of which test they will consent to.

PAS:  Los Angeles Peace Officers after suspecting that a person has been drinking will request them to take a PAS test.  This is where the individual is will be asked to blow into a device which will read the amount of Alcohol is in the person's body.  This exam is not mandatory and can be declined.  If one decides to not consent to the PAS test they should respectfully inform the officer of their intentions.

Breath Test Machine:  This test requires the person to blow into a machine that will read the alchol level in the person's body is .08% or more concentration.  This test is usually administered in the police station and by a qualified individual.  Two samples must be completed with signatures and time stamp.  There must also be a 15 minute break between exams.  More details of the requirements for administering a Breath Test can be found in Title 17 of the California Code of Regulations.

Blood Test:  If the individual decides to have blood drawn, the peace officer will usually transport them to a medical facility.  A consent form is signed and the proper medical staffer will administer the blood draw.  The blood sample is then sent to the lab and results are then received.

Urine Test:  If the individual consents to a urine test, then proper precautions are taken that the sample is not tainted.  No items are allowed in the restroom and the sample is then sent out to the lab for results.

Each test is not perfect.  If not administered correctly there could be serious flaws, this is why you need an experiencedLos Angeles DUI Lawyer to carefully go through the tests and make sure every step is correct.
