Chemical Testing for DUI

If you have been pulled over while operating or controlling a motor vehicle, you could be required to submit to a breath or blood test.  In fact, in the state of California, you are required by the Implied Consent Law to allow a test to determine your blood alcohol concentration (BAC) if you are lawfully arrested for DUI (driving under the influence).  There are generally two different types of chemical tests used in California:

Breath testing: the arresting officer can either test you using a handheld device on the scene, or you can be tested after your arrest.  You can, by law, refuse the handheld test.  However, if you refuse the test after you have been arrested, it will almost always result in losing your license for a period of time that is generally longer than you would if you were to be convicted of the crime.  

Blood testing: this type is more accurate than a breath test.  Only a qualified individual can draw blood and the blood must be sent to be tested.  You can request an independent test on your blood as well.
