About the Ten Day Rule

If you have recently been arrested for your first DUI offense, chances are you don't know about the 10 day rule. The 10 day rule is this: you must contact the DMV within ten days of your arrest to schedule an administrative hearing regarding the suspension of your driver's license. Without this hearing, an automatic hold will be put on your driver's license, suspending your driving privileges for a given amount of time. The DMV hearing will be completely separate from your criminal case and the results will not affect the criminal case in any way.

During the hearing with the California Department of Motor Vehicles, the following will be considered:

  • Was the arrest lawful?
  • Was your blood alcohol concentration above or below .08% when you were driving?
  • Was there reason to believe that you were driving under the influence of alcohol or drugs?

After facing a DUI arrest in Los Angeles, it is best to talk to a law firm that focuses primarily on DUI defense and criminal defense. At the Law Offices of Loren M. Merlin, this is exactly what you will get. You will want to trust your case to an experienced law firm, not to that of a public defender who has little time to spend on your case.

At our office, we can not only represent your case at the DMV hearing, but we can also represent your criminal case. At the criminal case, which is separate from the DMV hearing, your Los Angeles DUI attorney will have to provide evidence on your behalf. Finding this type of evidence and challenging any field sobriety tests, blood tests or breath tests will not be simple. Only an experienced lawyer will be able to do this thoroughly and effectively.
